SELECT AUSTRALIA 2020 - DISNEYLAND COMPETITION – TERMS AND CONDITIONS OF ENTRY 

  1. The Promoter is Select Australia Pty Ltd (ACN 003 881 052) of Unit 7, 53 Myoora Road, Terrey Hills, NSW, 2084;
  2. The competition will commence on 9:00am AEST 2 March 2020 and ends on 5:00pm AEST 28 August 2020 (the “Competition Period”);
  3. Australian residents (those aged under 18 years old will require consent from their parent or legal guardian) are eligible to participate (“Eligible Entrants”). Directors, officers, management, employees, and immediate family members of the Promoter, Agencies or entities (including participating outlets) associated with the competition may not participate.
  4. By entering into this competition you agree to be bound by these Conditions of Entry.
  5. This competition is authorised by the following permit numbers: ACT Permit No. TP 19/01921, SA Permit No. TP19/1754, NSW Permit No. TP19/39118 .

 

The Prizes

  1. The Prizes for this competition are detailed in the attached Schedule 1 and at the date of drafting of these terms, the total prize pool for this competition is $20,600.00
  2. Prizes may not be transferred or exchanged or redeemed for cash. Without limiting any other term in these Conditions of Entry, all prizes (and individual element of each prize) must be taken as and when specified by the Promotor or they will be forfeited in its entirety with no replacement. The prize values are correct at the date of preparing these Conditions of Entry. The Promoter is not responsible for the change in prize value and you agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide a replacement item of equal or higher value subject to any necessary approval by the relevant state/territory authorities.
  3. If you are the recipient of a prize, you must take part in all publicity, photography and any other promotional activity as determined by the Promoter without compensation. You further consent to the Promoter using only your name and image in any promotional or advertising activity.

 

How to Enter

  1. Eligible Entrants must first purchase a ‘Select Australia 2020 Footy Stars Pack’ (the “Pack”). These Packs may contain an Entry Card which grants the holder one entry into the competition. Eligible Entrants must also purchase at least fifteen (15) Packs in order to possess a Qualifying Entry. A Qualifying Entry will consist of:- (a) one completed Entry Card, (b) Original empty foil wrappers of fifteen (15) Packs.

STRICT COMPLIANCE WITH THESE TERMS ARE REQUIRED. NON-COMPLIANT ENTRIES ARE DEEMED INELIGIBLE

  1. All Eligible Entrants who submit a Qualifying Entry during the Competition Period will automatically be entered into the draws for the Major Prize and the Second Prize.
  2. All Eligible Entrants who submit a Qualifying Entry during the Competition Period will also be eligible for the Monthly Prize Draw. Multiple entries per Eligible Entrant are permitted.
  3. Any incomplete, misdirected, delayed, lost, misplaces, or illegible entries will be deemed invalid at the Promoter’s discretion. The Promoter will not be liable for your failure to comply with these Conditions of Entry.
  4. Entries are deemed to be entered at the time the Promoter receives the Qualifying Entry. All entries are the property of the Promoter and will not be returned.

 

The Prize Draw

  1. This competition is a game of chance and skill plays no part in determining the winner.
  2. Each prize draw shall be conducted using a randomised, non-computerised selection method at the Promoter’s Address (Unit 7, 53 Myoora Road, Terrey Hills, NSW, 2084). If necessary, an independent witness will be arranged to witness the prize draw.
  3. The prize draws for the Monthly Prizes, Second Prizes, and Major Prize shall be drawn on the dates detailed in ‘Schedule 2 – Prize Draw’ attached to these Terms and Conditions. Each prize winner will be contacted via the email address provided by the Eligible Entrant on the Entry Card. Each winner must respond to the email notifying them of their winning entry on or before the applicable Response Date of each respective prize draw as detailed in Schedule (the “Response Period”). If the winner does not respond on or before the applicable Response Date they shall be deemed to have forfeited their winning entry and any entitlement to the prize.
  4. The name and post code of each winner will also be posted on the Promoter’s website ( https://selectaustralia.com.au) and Facebook (https://www.facebook.com/selectaustralia) and will be updated on the dates detailed in Schedule 2
  5. In the event a prize is forfeited by an Eligible Entrant, the Promoter will re-award the relevant prize by carrying out a further prize draw the day after the Response Period ends and will notify the new winner accordingly.

 

The Major Prize Winner

  1. The winner of the Major Prize and their travelling companions (total travelling party of two adults and two children) must each have a valid passport and be able to travel at a to be agreed date between October 2020 and February 2021 (dates are subject to supplier availability at the Promoter’s absolute discretion). Prize winners and their travelling companions are also responsible for any associated travel costs such as but not limited to visas, travel insurance, taxi/transport costs, etc. Prize winners and their travelling companions will forfeit the prize if they are unable to travel for any reason whatsoever. The Promoter makes no representation as to the safety, conditions, or any other issues that may exist at any destination.
  2. All return flights will depart from one of Melbourne/Sydney/Brisbane (based on the closest city to the winners residence) only. Prize winners and their travelling companion are responsible for the all costs incurred in relation to travelling to the departure city if they do not ordinarily reside there.
  3. The Promoter cannot guarantee that the trip will be free from disruptions, failings or cancellations. We are not liable for such disruptions, failings or cancellations. Any requests for refunds or compensation arising from them should be sent to the relevant operator of the trip or insurer as applicable.
  4. The Major Prize winner and their and travelling companions will each be required to sign a Participation Agreement in order to redeem the Major Prize.
  5. Prize Travel and accommodation must be booked by November 2020 and must be completed by 28 February 2021. The Promoter will endeavour to book the Major Prize winner’s preferred dates, however is subject to availability. The Major Prize winner and its travelling companions must travel together on all prize travel and there can be no changes to travel or accommodation arrangements once tickets have been issued and confirmed.
  6. The Major Prize winner must be taken as stated and no compensation will be payable if the winner is unable to use the Major Prize as stated. The Major Prize is not exchangeable for cash or other goods or services, and it cannot be transferred consented to by the Promoter at its absolute discretion.
  7. It is a condition of accepting the Major Prize that the winner accepts all associated conditions of carriage, terms and conditions of booking, that the airline or accommodation provider may require Major Prize winner to accept.

 

General

  1. The Promoter’s decision in connection with all aspects of this competition is final and will not enter into any negotiation or discussion as to its decisions.
  2. The Promoter reserves its right to cancel or amend the promotion or to award similar alternative prizes of equal or greater value in the event of circumstances outside of its control subject to applicable state lottery and gaming laws.
  3. Nothing in these Conditions of Entry restricts, excludes, or modifies any consumer rights under any applicable statute.
  4. Subject to the previous clause, the Promoter and the agencies and companies association with this competition are not liable (including but not limited to negligence) for any loss (including indirect, special, consequential, or loss of profits), expenses, damages, personal injury, illness or death suffered in connection with this competition or the use or enjoyment of any prize or part thereof except for any liability which cannot be excluded under statute (in which case it is limited to the greatest allowed by law).
  5. The Promoter may at its absolute discretion prohibit an Eligible Entrant’s participation in this competition, cancel or suspend a prize or other cease to provide any prize to a winner if the entrant or winner (or any travelling companions) is (in the Promoter’s opinion) under the influence of alcohol or drugs, behaves aggressively or disruptively, or behaves in a manner which may diminish the good name and reputation of the Promoter or its products and brands, or is contrary to law or is otherwise inappropriate.
  6. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this Promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
  7. The Promoter and its associated agencies and companies will not be liable for any damage to or delay in transit of prizes.

 

Privacy and Personal Information

  1. The personal information Eligible Entrants provide will be used by the Promoter for the purpose of conducting this Promotion. The Promoter may disclose entrants’ personal information to companies and agencies connected with this Promotion and to relevant authorities in the Relevant States, and the winner’s name and State/Territory of residence may be published in accordance with these Conditions of Entry and as required under relevant legislation. The Promoter’s privacy policy is available at located at (https://selectaustralia.com.au/pages/privacy_policy) and contains information about:

(a) how you can seek access to the personal information the Promoter holds about you and seek the correction of such information;

(b) how you can complain about a privacy breach and how the Promoter will deal with such a complaint; and

(c) whether the personal information the Promoter holds about you will be provided to overseas companies, and if so, in which countries those companies are located.

  1. The Promoter is not affiliated and is not an agent of any AFL club, the Disney Corporation or the Australian Football League.

-        Four (4) return economy flights to Los Angeles from one of Melbourne, Sydney, or Brisbane on an airline of the Promoter’s choice

Grand Prize is valued at $9,800.00

 

* Must be under the age of 13 at the time the prize is drawn.

 

1 Accommodation is a family share room and is not upgradable. The Promoter is not responsible for additional accommodation costs including but not limited to hotel damages caused by the Major Prize winner and their travelling companions, room service, and/or incidentals.

 

 

 

10x Second Prizes 

Each prize shall consist of:-

-        1x Box 2020 Footy Stars Hobby Series Cards 

-        1x Select Hobby Album 

Each prize valued at $270.00, total value of Second Prizes = $2,700.00

 

 

Monthly Prizes

There will be Ten (10) Monthly Prizes to be won in each of the months of March 2020 through August 2020 inclusive (sixty (60) prizes total). Each monthly prize shall consist of:-

 

-        1x 2020 AFL Footy Stars Box

 

-        1x AFL Footy Stars Album

 

Each monthly prize is valued at $135 total value of Monthly Prizes = $8,100.00
